Actor Jussie Smollett will be sued by the City of Chicago after “refusing to reimburse” what prosecutors say was a staged racist, homophobic attack.

Last week, the Cook County State Attorney’s office caused uproar after dropping 16 counts against Smollett, who was accused of faking the alleged hate crime against himself in January this year. Mayor Rahm Emanuel and other officials were among those to criticise the decision.

Two days later, the city’s law department gave the Empire star seven days to pay $130,000 (£90,000) to the city. The deadline passed on Thursday 4 April and a civil complaint will be filed.

The city will “pursue the full measure of damages allowed” and added that a lawsuit will be filed “in the near future”.

“Mr Smollett has refused to reimburse the City of Chicago for the cost of police overtime spent investigating his false report on 28 January 2019,” the city said. “The Law Department is now drafting a civil complaint that will be filed in the Circuit Court of Cook County... The Law Department will file the suit in the near future. As part of this legal action, the Law Department will pursue the full measure of damages allowed under the ordinance.”

Smollett has maintained his innocence. On 29 January he told police that he was attacked by two men while walking on the street at 2am. He claimed that the men assaulted him, poured bleach on him and put a noose around his neck while hurling racist and homophobic abuse.

Police later concluded that Smollett had hired his personal trainer, Abel Osundairo, and the trainer’s brother Ola, to stage the attack. Police alleged he was seeking a higher salary from Empire. Speaking on the decision to drop the charges against him, State Attorney’s Office said that it stands by the police investigation, but that Smollett’s case was not serious enough to warrant jail time.
