Demi Moore could face lawsuit for 'negligent supervision' after 21-year-old drowns in pool

Demi Moore may face charges relating to ‘negligent supervision’ after a young man drowned at a party thrown at her house by her assistant.

Moore was out of the country when 21-year-old Edenilson Steven Valle drowned in the pool of her Beverly Hills home, but lawyers suggest she could still be held responsible for the safety of any attendees at a party thrown by someone she employs.

Entertainment lawyer Julian Chan told Fox News that employers are liable for the acts of their employees whether they are on the premises or not.

“In having a party around a pool where people might become intoxicated, a host has a responsibility to ensure their safety,” he said.

A coroner said Valle was pulled from the pool after he was found floating in the deep end.

He was pronounced dead at approximately 5.30am local time on Sunday morning. Valle’s family and friends told investigators that he could not swim.

Attorney Leo Terrell added that the onus would be on Moore, the home-owner, for failing to provide a safe environment for guests.

“As the homeowner, she will be accused of failing to provide proper pool supervision,” Terrell said. “[Any potential] lawsuit will attack Demi's failure to insure the safety of the guests from the danger of the pool.”

Moore paid her respects during a statement released by her publicist:

"I am in absolute shock," the statement reads. "I was out of the country traveling to meet my daughters for a birthday celebration when I got the devastating news.

"The loss of a child is an unthinkable tragedy, and my heart goes out to this young man's family and friends. I ask that you please respect the privacy of all concerned during this sensitive time."
