A judge is to decide today whether to send media mogul Conrad Black back to prison or let him remain free based on time already served.

US district judge Amy St Eve is scheduled to resentence former Daily Telegraph boss Lord Black in Chicago after an appellate court threw out two convictions and upheld two others last year.

A jury convicted Black in 2007, and the judge sentenced him at the time to six-and-a-half years for defrauding investors in Hollinger International.

But Black was freed on bail after serving two years to enable him to pursue partially successful appeals.

The appellate court ruled that Black would have to be resentenced on the two confirmed charges - one fraud count and one of obstruction of justice.
