A mental hospital nurse who was reinstated after being struck off for raping a "vulnerable" former patient was ordered by a High Court judge yesterday to be suspended once more from the professional register pending legal action by the Royal College of Nursing to stop him working again.

Yuen How Choy, 50, was convicted of the rape in 1984 and received two years' imprisonment, suspended for 12 months. The offence was committed while he was a staff nurse for Brighton Health Authority. He already had a previous conviction, in 1972, for sedating a patient in order to have sex with her. There was an outcry in the nursing profession when Choy was restored to the register of nurses by the UK Central Council for Nursing, Midwifery and Health Visiting in March this year.
