Metropolitan Police officer who resisted arrest after bar fight while drunk on night out dismissed

A police officer who allegedly resisted arrest while drunk has been formally dismissed after a three-day misconduct hearing.

PC Mark Toulson was off-duty when he went been drinking with a friend in Wimbledon in November 2014.

A row broke out, causing police officers to be called to the bar and take Toulson to hospital for treatment for a head injury.

He then threatened to fight officers when being taken into custody from hospital.

“I’ll walk down to the van without a fuss, but if you handcuff me I’ll fight you,” he said, according to the Evening Standard.

A spokesperson for the Metropolitan Police said the Wandsworth officer allegedly used threatening, abusive and insulting behaviour towards an officer.

The 35-year-old was accused of assaulting an officer and then obstructing and resisting them in the execution of their duty.

In a case at Wimbledon Magistrates' Court, defence lawyers said Toulson may have been suffering the effects of a head injury including "automatism", making him perform actions involuntarily.

In July last year, he pleaded guilty to resisting a constable in execution of duty but denied assault and the use of threatening and abusive behaviour. He was fined £443.

His case was subject to a separate misconduct hearing on whether the incident had amounted to a breach of the Met's Standards of Professional Behaviour, which concluded on Wednesday.

"After hearing all the evidence and mitigation, the panel deemed the most appropriate outcome to be dismissal without notice," a spokesperson said.
