A Texas man accused of raping a woman who asked him to use a condom during the attack was convicted of aggravated sexual assault yesterday, Reuter reports from Austin. Last September a grand jury declined to indict Joel Rene Valdez on grounds that the woman's request he use a condom implied that she consented to sex.
The 26-year-old victim testified at the trial that she asked Valdez to use a condom so she could protect herself from Aids or pregnancy.
